Terms and Conditions of the online store

The Website is available at: www.aromvap.pl (hereinafter: the "Website" or the "Store").
§2. Scope of application and definitions
These terms and conditions (hereinafter: the "Terms and Conditions") define the rules for providing electronic services, creating an account, placing orders, and concluding and performing distance sales agreements for goods offered by the Seller to consumers within the **European Union**.
The terms used mean:
- Customer – a natural person with full legal capacity, making a purchase for a purpose not directly related to their business or professional activity (consumer) or, when expressly provided, an entrepreneur.
- User – a person who has set up an account on the Website.
- Goods – fragrance aromas intended for burners, diffusers, and other aromatherapy devices, as well as accessories related to their use.
- Order – the Customer's declaration of intent aimed directly at concluding a sales agreement.
- Account – the User's administrative panel on the Website.
- Carrier – the entity performing the transport, selected by the Customer or indicated by the Seller.
- Country of destination – the Member State of the European Union to which the Goods are delivered at the Customer's request.
§3. Language, applicable law, and jurisdiction
Agreements are concluded in Polish, English, or another language available on the Website. In case of discrepancies, the Polish version is binding.
For agreements concluded with consumers, the law of the country of the consumer's habitual residence applies, taking into account the mandatory provisions of that country protecting consumers.
The consumer has the right to bring a case to court both in the country of their habitual residence and in the country where the Seller has its registered office. They can also use the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr.
§4. Access to the Website, Account, and registration
Account registration on the Website is voluntary but may be required to place an order. The User is obliged to provide true and up-to-date data and to protect the confidentiality of their login details.
The Seller may refuse to create an account or conclude an agreement in the event of a justified suspicion of providing false data, violating the Terms and Conditions, or an attempted abuse.
§5. Information about Goods and safety
The Goods offered on the Website are fragrance aromas, intended exclusively for use in fragrance burners, diffusers, or similar aromatherapy devices. They are not intended for consumption or direct inhalation.
Before use, read the instruction manual of the device for which the aroma is used. Store in a dry, cool place, out of the reach of children and pets.
Photos and descriptions of the Goods on the Website are for informational purposes and may slightly differ from the final product. Colors may vary depending on monitor settings.
§6. Prices, currencies, VAT, and invoicing
Prices are given in the website's currency and include VAT (gross prices). In the case of sales to another EU country, VAT is charged at the rate applicable in the country of destination (OSS procedure – One Stop Shop).
Delivery costs are not included in the prices and are communicated to the Customer during the order placement process.
Available payment methods are indicated in the Order placement process. VAT invoices are issued upon the Customer's request.
§7. Placing Orders and concluding the agreement
Placing an Order by the Customer constitutes an offer to conclude a sales agreement. The agreement is concluded when the Seller sends the Customer confirmation of acceptance of the Order for processing to the provided e-mail address.
The Seller reserves the right to refuse to process the Order for important reasons, in particular: lack of goods, problems with payment authorization, an error in the price or description of the goods on the Website.
§8. Delivery, costs, and risk
Deliveries are carried out within the European Union, to the address provided by the Customer.
The Customer bears the delivery costs according to the selected option. Delivery times are estimated. Delays resulting from the Carrier's actions are not the Seller's fault.
The risk of damage to or loss of the Goods passes to the Customer at the moment the package is handed over to the Carrier by the Seller.
§9. Right of withdrawal
A Customer who is a consumer has the right to withdraw from a distance agreement without giving any reason within 14 calendar days from the day of receiving the package with the Goods or, in the case of services, from the day of concluding the agreement.
To exercise this right, the Seller must be informed of the decision by sending an unequivocal statement (e.g., on a withdrawal form) to the e-mail address: tijara.czech@gmail.com.
The Goods must be sent back to the Seller's address provided in §1 intact, in their original, undamaged packaging, without delay, and no later than 14 days from the day of informing about the withdrawal. The cost of return is borne by the Customer.
The refund will be made within 14 days of receiving the Goods back or the Customer providing proof of their return, using the same payment method.
The right of withdrawal does not apply to sealed goods which, after opening the packaging, are not suitable for return due to health protection or hygiene reasons (e.g., opened bottles with liquid aroma), unless the Seller agrees to it.
§10. Complaints and warranty
Complaints regarding the Goods should be submitted to the e-mail address: tijara.czech@gmail.com providing the order number and description of the defect.
Complaints will be processed in accordance with the law applicable to the agreement, and in the case of consumers – taking into account the mandatory consumer protection laws of the country of their residence.
Selected Goods may be covered by a manufacturer's warranty, the terms of which are specified in a separate document. The warranty does not exclude the consumer's rights under the statutory warranty/physical defect.
§11. Personal data protection
Detailed information on the processing of Customers' personal data can be found in a separate Privacy Policy, available on the Website.

§12. Intellectual property
All content (texts, graphics, logos) available on the Website is the property of the Seller or its partners and is legally protected.
§13. Force majeure
The parties are not liable for non-performance of obligations caused by events that they could not foresee or prevent despite exercising due diligence (e.g., actions of authorities, strikes, natural disasters, epidemic situations, border blockades, system failures). In such a case, the order processing time is extended by the duration of the event.
§14. Intellectual property and User content
All materials available on the Website (e.g., texts, graphics, logos, layouts, databases) constitute the intellectual property of the Seller or its licensors and are protected by law. Their use in any way without the written consent of the Seller is prohibited.
By publishing an opinion, review, or other content on the Website, the User grants the Seller a free, non-exclusive license to use this content for purposes related to the functioning and promotion of the Website.
§15. Changes to the Terms and Conditions and archiving
The Seller reserves the right to amend the provisions of the Terms and Conditions for important reasons. The Customer (consumer) will be informed in advance about significant changes, and the changes will not apply to agreements concluded before they enter into force.
Archival versions of the Terms and Conditions are available for viewing on the Website.
§16. Final provisions
In matters not covered by these Terms and Conditions, the relevant legal provisions apply. In the case of agreements with consumers, the mandatory consumer protection laws of the country of the consumer's residence apply in the first place.
The Terms and Conditions enter into force on the date of their publication on the Website.
Return Policy of the online store
§1 General provisions
These regulations define the rules and conditions for returns of goods purchased in the online store https://aromvap.pl/ by Customers.
The term "Customer" means a natural person making purchases in the AromVap online store.
The rules for returning goods apply to all products offered in the online store https://aromvap.pl/.
§2 Right of withdrawal
The Customer has the right to withdraw from the agreement without giving any reason within 14 days from the date of receiving the goods, in accordance with applicable law.
The right to withdraw from the agreement does not apply to goods that are not suitable for return due to health or hygiene reasons if they have been opened after delivery.
To exercise the right of withdrawal, the Customer must inform Tijara Essence s.r.o. about their decision in the form of an unequivocal statement, e.g., by sending an e-mail or using the return form available on the store's website.
The return of the goods should take place at the Customer's expense in an unchanged state, unless a change was necessary within the limits of ordinary management.

undertakes to refund the payment for the returned goods within 14 days from the receipt of the withdrawal statement. The refund will be made using the same payment method that the Customer used in the original transaction, unless they expressly agreed to a different refund method.
§3 Return procedure

The goods should be returned in their original packaging, complete, with no signs of use, with a complete set of documents (e.g., receipt/invoice).
The Customer is responsible for properly securing the goods during return transport.
Tijara Essence s.r.o. reserves the right to refuse to accept the return of goods that do not meet the conditions specified in these regulations.
§4 Complaints
In case of receiving defective goods, the Customer should immediately contact the online store's customer service to submit a complaint.
Tijara Essence s.r.o. reserves the right to process the complaint within 14 days from the date of receiving the complaint notification.
§5 Final provisions
This return policy enters into force on the date of its publication on the website https://aromvap.pl/.
Tijara Essence s.r.o. reserves the right to change the return policy. The changes come into effect upon their publication on the store's website.
In matters not covered by these regulations, the relevant provisions of Polish law shall apply.
